Streamlined employer requirement for Subclass 186 Temporary Resident Transition

The Department of Home Affairs has announced that it will broaden the test used to determine whether employees are eligible for the Temporary Resident Transition (‘TRT’) stream of the Employer Nomination Scheme 186 Permanent Residency visa. The current test penalises employees where their employer undergoes changes to business structure. In these circumstances employees have been forced to complete a further 2 years employment before qualifying for the TRT stream.

The policy will take effect from 1 July this year and will ensure greater certainty for both employees and employers.
